Terms of Service Agreement for "How is it?"

These Terms of Service ("Agreement") govern the use of the "How is it?" SaaS product ("Service") developed by Webstone Technologies Inc. ("Webstone," "we," "our," or "us"). The Service is provided through the website https://howisit.app/ ("Website") and enables customers to add a feedback widget to their website to collect feedback from their visitors. By accessing or using the Service, you ("Customer," "you," or "your") agree to be bound by this Agreement.

Use of Service

You may use the Service only for lawful purposes and in accordance with this Agreement. You agree not to use the Service:

  • (a) in any way that violates any applicable federal, state, local, or international law or regulation;
  • (b) to engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service;
  • (c) to impersonate or attempt to impersonate Webstone, a Webstone employee, another user, or any other person or entity;
  • (d) to upload, post, or transmit any content that is offensive, harmful, defamatory, or otherwise objectionable;
  • (e) to upload, post, or transmit any content that infringes any patent, trademark, trade secret, copyright, or other intellectual property or other rights of any party;
  • (f) to transmit any unsolicited or unauthorized advertising, promotional materials, spam, junk mail, chain letters, or any other form of solicitation;
  • (g) to transmit any viruses, worms, defects, Trojan horses, or other items of a destructive nature; or
  • (h) to interfere with or disrupt the Service or servers or networks connected to the Service.

Customer Data

The Service allows you to collect feedback from your visitors through the feedback widget. You acknowledge and agree that all data collected through the feedback widget ("Customer Data") is your responsibility, and you are solely responsible for the accuracy, quality, legality, and integrity of the Customer Data. Webstone is not responsible for any Customer Data, and you agree to indemnify and hold Webstone harmless from any and all claims arising out of or related to your use of the Service, including any claims related to Customer Data.

Ownership and Intellectual Property

Webstone owns all right, title, and interest in and to the Service, including all intellectual property rights. This Agreement does not grant you any right, title, or interest in or to the Service or any Webstone intellectual property. You may use the Service only as expressly permitted by this Agreement.

Privacy

Webstone's privacy policy, available at https://howisit.app/privacy-policy/, explains how we collect, use, and disclose information about our users, including the Customer Data. You agree to comply with the privacy policy and acknowledge that Webstone may update the privacy policy from time to time in its sole discretion.

Payment

The Service is offered on a subscription basis. You agree to pay all fees associated with your subscription to the Service in accordance with the pricing and payment terms available on the Website. You authorize Webstone to charge your chosen payment method for all fees incurred in connection with your use of the Service.

Term and Termination

This Agreement will remain in effect until terminated by either party. You may terminate this Agreement by canceling your subscription to the Service. Webstone may terminate this Agreement immediately upon notice to you if you breach any provision of this Agreement. Upon termination, you must immediately cease all use of the Service.

Limitation of Liability

WEBSTONE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THIS AGREEMENT OR YOUR USE OF THE SERVICE
